Terms of services
These terms of service policy governs the relationship between bharatkengo.com hereinafter referred to as ("the App," "the Portal," "the Company," "BharatKeNGO") and the user hereinafter referred to as ("the user," "you," "the donor"). By accessing or using the App or the Portal, you agree to abide by this Policy. If you do not agree with any part of this Policy, you should refrain from using the App or the Portal. This Policy outlines the terms and conditions under which you may access and use the services provided by BharatKenGo.com, including but not limited to donation services, NGO ratings, and any other features offered by the Company. It also covers your rights, responsibilities, and obligations as a user of the App or the Portal. Please read this Policy carefully before using the services provided by bharatkengo.com
Registration
- Account Creation: In order to use the App, you must register for an account. You agree to provide accurate and complete information during the registration process, including but not limited to your full name, mobile number, email address, city, and state.
- Age Requirement: By registering for an account, you affirm that you are at least 18 years old or the legal age of majority in your jurisdiction. If you are under the age of 18, you must obtain parental or guardian consent before registering for an account.
- User Verification: The Company may require you to verify your email address or mobile number during the registration process to prevent fraud and ensure the security of your account.
- Username and Password: You are responsible for choosing a secure password and maintaining the confidentiality of your account credentials. You agree not to share your password with anyone else or allow anyone else to access your account.
- Profile Information: You may be required to provide additional profile information, such as a profile picture or bio, which will be publicly visible to other users of the App.
- Accurate Information: You agree to keep your account information up to date and accurate at all times. If any of your information changes, you must update it promptly within the App.
- Multiple Accounts: You may not create multiple accounts for the purpose of abusing the App or engaging in fraudulent activities.
- Account Suspension or Termination: The Company reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, if it believes that you have violated these Terms or engaged in any fraudulent, abusive, or illegal activities.
- Data Security: While the Company takes measures to protect the security of your account information, including encryption and secure protocols, you acknowledge that no security measures are 100% foolproof. You agree to use the App at your own risk and to notify the Company immediately of any unauthorized access or use of your account.
User Content
- Content Submission: The App may allow you to post, upload, or submit content, including but not limited to ratings, reviews, comments, messages, and images ("User Content").
- Ownership of User Content: By posting, uploading, or submitting User Content, you retain ownership of the intellectual property rights in that content. However, by submitting User Content, you grant the Company a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the operation of the App and the Company's business activities.
- Content Standards: You agree not to post, upload, or submit any User Content that is unlawful, defamatory, libelous, obscene, threatening, invasive of privacy, infringing of intellectual property rights, or otherwise objectionable.
- Responsibility for User Content: You are solely responsible for the User Content you post, upload, or submit, and you agree to indemnify and hold harmless the Company from any claims arising out of or relating to your User Content.
- Public Visibility: User Content may be publicly visible to other users of the App. By submitting User Content, you acknowledge and agree that it may be viewed, shared, and commented on by other users.
- Content Moderation: The Company reserves the right, but has no obligation, to monitor, review, or remove User Content that it determines, in its sole discretion, violates these Terms or is otherwise inappropriate or harmful.

Prohibited Content: Prohibited User Content includes, but is not limited to, content that:
- Infringes upon the rights of any third party, including intellectual property rights.
- Contains viruses, malware, or other harmful code.
- Harasses, threatens, or abuses others.
- Promotes discrimination, hatred, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
- Contains false or misleading information.
- Violates any applicable laws or regulations.
- User Feedback: The Company welcomes feedback and suggestions regarding the App and its features. If you provide any feedback or suggestions, you grant the Company the right to use such feedback or suggestions without any obligation to compensate you.
- Monitoring and Enforcement: The Company may, but is not obligated to, monitor or review User Content. The Company reserves the right to remove or disable access to any User Content that violates these Terms, without prior notice.
- Reporting Violations: If you believe that any User Content violates these Terms or is otherwise inappropriate, please report it to the Company using the designated reporting mechanism within the App.
Donations
- Making Donations: The App facilitates donations to registered NGOs. By making a donation through the App, you agree to abide by the terms and conditions set forth by the respective NGO and any payment processor used by the Company.

Donation Process:
- Selection of NGO: Users can select the NGO they wish to donate to from a list of registered NGOs available on the App.
- Amount and Payment Method: Users can choose the donation amount and payment method (e.g., UPI, credit/debit card) within the App.
- UPI Payment: Users are bound to make donations using the UPI (Unified Payments Interface) provided within the App. Donations made through other channels will not count towards the App's donation verification process.

Verification Process:
- NGO Verification: Once a user makes a donation through the App, the respective NGO will be notified to verify the donation from their end.
- Processing Time: Verification by the NGO may take up to a few hours or a maximum of three days. During this time, the status of the donation will be shown as "Pending Verification" in the App.
- Completion of Donation: Once the NGO verifies the donation, the status will be updated to "Verified" within the App, indicating that the donation has been successfully received and acknowledged by the NGO.
- Failed Verification: If the NGO fails to verify the donation within the specified time frame, the donation status will be marked as "Failed Verification" in the App, and the user may be eligible for a refund, subject to the NGO's policies.

- The donation is made in error (e.g., incorrect amount, technical issue).
- Refund Process: Users can request a refund by contacting customer support within the App. Refunds will be processed in accordance with the Company's refund policy.

- Prohibited Uses: Prohibited actions include, but are not limited to, scraping, data mining, reverse engineering, or any other unauthorized use of the App or its content.

- Prohibited Activities: Users are prohibited from tampering with, copying, distributing, or using NGO QR codes for any unauthorized or fraudulent purposes.
- Consequences of Misuse: Any unauthorized use of NGO QR codes may result in suspension or termination of your account and may be subject to legal action.

Creating Fake NGO Accounts:
- Prohibited Conduct: You agree not to create fake or misleading accounts for NGOs or engage in any other deceptive practices on the App.
- Verification Process: NGOs must undergo a verification process to ensure their legitimacy. Creating fake NGO accounts undermines the integrity of the platform and is strictly prohibited.
- Consequences: Any user found to be creating fake NGO accounts may have their account suspended or terminated, and the fake NGO account may be removed from the platform.

- Accountability: You are solely responsible for your use of the App and for any consequences arising from your actions.
- Indemnification: You agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or losses arising from your use of the App in violation of these Terms.
